Health-care-supreme-court-protestOn Monday, the case of the century got even bigger. In challenges to the Affordable Care Act in lower courts, several judges gave the Supreme Court an escape hatch. These judges, including Brett Kavanaugh, a young judge sure to make Republican short lists for the Supreme Court, said that the Justices should kick the can down the road and put off a decision for a year or two. Specifically, Kavanaugh said that the Tax Anti-Injunction Act (a deeply obscure law) compelled the Justices to put off a decision on the law until it takes full effect, in 2014.

Across the ideological spectrum, the Justices, through their questions to the lawyers arguing for and against the upholding the A.C.A., declined the invitation for delay. They all (that is, the eight who asked questions; Clarence Thomas did not) seemed to recognize that there were legal and prudential reasons to resolve this issue now. As Justice Ruth Bader Ginsburg said, the act ?does not apply to penalties that are designed to induce compliance with the law, rather than to raise revenue. And this is not a revenue-raising measure because, if it?s successful, they?nobody will pay the penalty, and there will be no revenue to raise.? The Court, it now seems clear, will decide this case on the merits.

(AP) ? Sean Payton's season-long suspension for New Orleans' bounty system begins at the end of the week.

Maybe.

NFL Commissioner Roger Goodell said Monday an appeal by Payton could leave him in charge of the Saints ? at least temporarily.

"I said in a letter they have to appeal by April 2, I believe," Goodell said at the owners meetings. "If he decides to appeal, I probably will allow him to continue and I would expedite the hearing and I would expedite my decision.

"We did meet twice and went through the information. If he has something else for me to consider, I will."

Otherwise, Payton will be gone until after the Super Bowl for his involvement in the bounty program that ran for three seasons, including the team's 2009 championship run.

Asked if Payton's punishment was as much for lying to him as it was for the actual bounties program, Goodell told a packed news conference about a pattern of untruths.

"This is a violation of a very serious rule," Goodell said. "We have made player health and safety very clear as a priority. During the process of when this first was raised two years ago, there were denials. They were not forthright and that continued through our investigation.

"This is something with zero tolerance and is not acceptable."

Payton's agent, Donald Yee, said "no decisions have been made about an appeal" by his client.

"Sean fully supports the league's player safety goals," Yee said. "Given this, he probably won't address the entire league" when he arrives at the owners meetings.

Payton has not addressed the media since the suspension, but has issued two written statements apologizing for the bounty system. He could speak when NFC coaches meet the media Wednesday morning.

Goodell also is waiting for recommendations from the players' union before punishing any players for participating in the bounty system that targeted opponents for big hits. He has discussed the bounties with NFLPA leader DeMaurice Smith.

"We would like to do (the players' sanctions) as soon as reasonable," Goodell said. "I expect to talk to him by the end of the week. We shared our confidential reports with him."

The league's investigation is continuing, Goodell added.

"We will continue to follow on any information we have," he said, "and will look for violations. If we get info, we will follow on it.

"Let's be clear. We discussed it with the clubs today and I think it is fair to say non-contract bonus payments were happening around the league ... and that'll discontinue."

Goodell added the league approached the Saints before their playoff game with the Lions in January and warned them to make sure the bounties had ceased. He sent Jeff Pash, the NFL's lead counsel, and Jeffrey Miller, its director of security, to speak with owner Tom Benson.

"The point was to make it clear we had new and credible info and he should make it extremely clear with the game the next day there should be no bounty system in place," Goodell said.

Goodell said the Saints are free to go outside the organization to hire a coach. Payton's assistant head coach is Joe Vitt, who was given a six-game suspension, while general manager Mickey Loomis received eight games. The team was fined $500,000 and lost second-round draft picks this year and next.

Gregg Williams, who as Saints defensive coordinator oversaw the bounty pool, has been suspended indefinitely. He left New Orleans for the same coaching position in St. Louis earlier this year.

Benson continues to back both Loomis and Payton, a person familiar with the situation has told The Associated Press, speaking on condition of anonymity because the Saints have made no announcements about Payton's future.

Bill Parcells said Monday he has not been approached about becoming interim coach of the Saints, but he has spoken to Payton about how to handle the season. The coach who led the New York Giants to two Super Bowl victories is a mentor to Payton, and hired Payton as an offensive assistant in Dallas in 2003.

Goodell termed "inaccurate" reports that one player turned in the Saints in the bounties investigation.

"You're assuming it's a player," he said. "We have several sources on this. We're not disclosing who our sources are."

As Goodell and the NFL emphasize player safety, they will consider several rules changes this week. One that they already made ? moving the kickoff up 5 yards to the 35-yard line last year ? paid the dividends they sought.

"The kickoff rule had an effect on the game," said Rich McKay, chairman of the league's competition committee. "There was a 40 percent reduction in concussions on that play."

Mckay admitted surprise that total kickoff returns dropped 53 percent.

For all plays, concussions were down 12.5 percent, from 218 in 321 games in 2010 to 190 in 320 games last season; there was no Hall of Fame game last year because of the lockout.

Owners will vote this week to further enhance player safety by outlawing horse-collar tackles on passers in the pocket, a proposal made by the Pittsburgh Steelers. The owners also will consider expanding protection of defenseless players to those who are hit by crack-back blocks. The proposal calls for outlawing contact to the head area or being blocked by an opponent headfirst.

"We saw some hits we wanted to make sure that players changed their hit points on," McKay said.

Group Wants To Recall Petition Against Apple (Not That It Matters)

Apple-MoneyA group is asking Change.org to withdraw the petition which asked Apple to protect workers' rights in China. The petition, which had previously gathered over 255,000 signatures before being delivered in-person to Apple stores in major U.S. cities, including New York, recently made headlines following a New York Times series on the harsh conditions of factory workers in China. The series examined the working lives of those tasked with building our favorite gadgets, like iPhones and iPads. But one of the critical stories that helped lead the crusade, and therefore the petition, was that of American playwright Mike Daisey, whose one-man show attempted to get his audience to think about the origin of their beloved iGadgets. Unfortunately, his story?turned out to be partially false.?Now a second group wants the original petition recalled, saying "Apple is already doing more for worker rights in China than just about any other IT company that deals with Chinese suppliers." Oops.

Scientists identify novel pathway for T-cell activation in leprosy

ScienceDaily (Mar. 25, 2012) ? UCLA researchers pinpointed a new mechanism that potently activates T-cells, the group of white blood cells that play a major role in fighting infections.

Published March 25 online in Nature Medicine, the team specifically studied how dendritic cells, immune cells located at the site of infection, become more specialized to fight the leprosy pathogen known as Mycobacterium leprae. Dendritic cells, like scouts in the field of a military operation, deliver key information about an invading pathogen that helps activate the T-cells in launching a more effective attack.

It was previously known that dendritic cells were important for a strong immune response and the number of such cells at an infection site positively correlated with a robust reaction. However, until now it was poorly understood how dendritic cells become more specialized to address specific types of infections.

The researchers found that a protein called NOD2 triggers a cell-signaling molecule called interleukin-32 that induces general immune cells called monocytes to become specialized information-carrying dendritic cells.

"This is the first time that this potent infection-fighting pathway with dendritic cells has been identified, and demonstrated to be important in fighting human disease," said the study's first author Mirjam Schenk, postdoctoral scholar, division of dermatology, David Geffen School of Medicine at UCLA.

In conducting the study, scientists used monocytes taken from the blood of healthy donors and leprosy patients and incubated the cells with the pathogen M. Leprae or specific parts of the mycobacteria, known to trigger NOD2 and TLR2, both associated with immune system activation.

Scientists wanted to investigate how these proteins might trigger mechanisms that turn on different immune receptors that recognize specific parts of the microbe in an infection. The NOD2 interleukin-32 pathway was the most effective and caused monocytes to develop into dendritic cells that carry critical information about the pathogen to the T-cells.

The team studied the gene expression profiles of the protein-triggered pathways and then also examined how the monocytes of leprosy patients responded to NOD2. Scientists found that NOD2 worked to induce moncytes to dendritic cells in tuberloid leprosy, a milder infection that is more easily contained. The NOD2 pathway was inhibited and could not be activated in lepromatous leprosy, which is more serious and causes widespread infection throughout the body.

"We were surprised to find the high potency of the dendritic cells in triggering certain specific T-cell responses, which may be useful in developing new therapeutic strategies for infectious diseases and cancer," said senior investigator Dr. Robert Modlin, UCLA's Klein Professor of Dermatology and chief of dermatology at the Geffen School of Medicine.

Leprosy, one of the world's oldest known diseases, is a chronic infectious disease that affects the skin, the peripheral nerves, the upper respiratory tract and the eyes and can lead to disfigurement of the hands, face and feet. In 2008, approximately 249,000 new cases of leprosy were reported worldwide, according to the World Health Organization.

Modlin adds that leprosy is a good model to study immune mechanisms in host defense since it presents as a clinical spectrum that correlates with the level and type of immune response of the pathogen.

The next stage of research will involve trying to further understand how to manipulate the innate immune system to induce a potent immune response in human infections and possibly for cancer immunotherapy as well.

First off, I know some people will think, ?If you have to ask, then you shouldn?t be in the business?, but everyone needs help from somewhere to achieve success. I currently have a security business doing site patrol, both mobile and foot, with insurance, all the required licensing and registration, and equipment.The main problem I am having is marketing to clients and how to approach them. I have tried email and calls, but I realize now this won?t work. I recently got some brochures to hand out initially when coming to a company and also some reminder postcards to send out afterwards. Is this a proper/effective way to go about marketing and getting clients? I?d like to hear from other business owners involved in sales how they go about getting clients for their companies? Any tips are much appreciated.Also, what type of advertising has been the most successful, excluding word of mouth?

>> if they're going to be a little different, we might as well today with what we have instead of taking a risk with what may be the etch a sketch candidate for the future. i said the other day that we need a real choice in this election. i'm going to support whoever wins the republican primary to beat out obama. that's the number one issue.

>> before that latest remark, the romney campaign said, as senator santorum continues to drag out this already expensive, negative campaign , it is clear that he is becoming the most valuable player on president obama 's team. we bring in now our political panel. a.b. stoddard, and democratic strategist, jimmy williams . great to see both of you this afternoon. i want to start with you. it seems that rick santorum realized he may have gone a little too far with that initial comment, backtrack quickly. he normally doesn't backtrack this fast.

>> i think he received a few phone calls as well as the aggressive comments that the romney camp came up with pretty quickly. this is not good for rick santorum . he is actually slipping away from relevance at this point. a few weeks ago he was a legitimate contender. he lost significant contests in michigan and ohio. very close races he might have won. and this is slipping away from his grasp. he might do very well tomorrow night but it won't yield him a lot of delegates. he'll still be behind in a 2-1. he is starting to sound like newt gingrich where his comments from yesterday sounded as if he was more interested in defeateding mitt romney out of some kind of spite than defeating the read that. that's the kind of thing that causes party leaders and people who have been supporting -- and his been factors. foster freese people fueling his super pac. they don't like that kind of talk. you've seen where his support has gone.

>> as a.b. points out, the relevance for rick santorum may be waning. when we talk about what's coming in louisiana , romney is 0-6 when we talk about contested southern primaries. louisiana right ahead of us. the polls indicate that santorum is ahead in that state. another loss, a southern loss really hurt romney or as a.b. points out, can he just stick out through the south and remain the top contender.

>> i think she is right. he could lose every race in the primary and then carry the south in the fall. i don't think anyone think that's won't happen. however, rick santorum saying this, a.b. is dead on with this. it hurts him. it also hurt hill more importantly with conservatives. while conservatives may not like mitt romney , they really hate barack obama . and if you don't believe me, at the very same press clip that you just played from today of rick santorum in louisiana , right before that when he was firing his pistols at target practice, a woman shouted out. pretend it's obama. i don't know who that woman was, i don't know if she was white or black. i guarantee you she was a conservative voter. she was there to see rick santorum . you say those things and it doesn't help with you the conservative base.

Facebook buys patents from IBM to defend itself

(AP) ? Facebook has acquired patents from IBM as it girds itself for litigation, including a lawsuit by Yahoo.

A company spokesman on Thursday confirmed the purchase but did not provide details.

Earlier, Bloomberg News said Facebook acquired 750 patents covering technologies dealing with software and networking. It cited a person with knowledge of the transaction who was not named in the report Thursday.

Last week, Yahoo Inc. sued Facebook, saying the social networking giant had infringed on 10 of its patents covering advertising, privacy controls and social networking. Facebook had said it found the action "puzzling" and vowed to defend itself.

IBM declined to comment on the report.

As with many patent suits, the battle between Yahoo and Facebook will likely be resolved in a settlement or licensing deal.

In early February, Facebook filed papers for a planned $5 billion initial public offering of stock that would be the biggest ever for an Internet company.

The patent claims, however, cast a spotlight on Facebook's vulnerabilities as the company tries to complete an IPO this spring. At the end of 2011, Facebook had just 56 U.S. patents, a relatively small number compared with other big tech companies. Yahoo owns more than 1,000 patents.

U.S. Underestimates Long-Term Costs of Obesity, Experts Say

WEDNESDAY, March 21 (HealthDay News) -- The costs of the obesity epidemic to the United States and the economic value of curbing it are not captured fully by current methods, according to a new report.

The problem is that estimates used by Congress when it looks at these issues project out only 10 years, while it may take much longer than that for complications of obesity, such as diabetes and heart disease, to manifest, the report authors say.

For example, "a person with diabetes is not going to go on dialysis right away. They're going to go on dialysis 10 to 12 years after their diagnosis," said Michael O'Grady, co-author of the report, released Wednesday by the Campaign to End Obesity.

A 25-year window for making policy decisions would be more appropriate when drafting policies aimed at curbing disease, he said at a Wednesday morning press conference.

By the same token, measures to prevent obesity can take 20 or more years, perhaps even generations, to show their promise, the report said. A wider time window would enable policy makers to assess the cost-effectiveness of preventive programs, the report noted.

"Interventions aimed at children will not have their full payoff until those children are adults," said Dr. James Marks, senior vice president and director of the Health Group at the Robert Wood Johnson Foundation, which funded the study.

Nor will the success of interventions aimed at pregnant women be seen for many years, noted the study's authors, speaking at the briefing.

O'Grady, citing current CDC figures, said more than one-third of U.S. adults are overweight, another one-third are obese and 6 percent are extremely obese.

"That's right around three-quarters of the population," said O'Grady, a senior fellow for health care research at the National Opinion Research Center at the University of Chicago and a principal with O'Grady Health Policy, LLC.

One estimate puts the annual cost of obesity at $147 billion, representing almost 10 percent of all medical expenses, the report said. But the Society of Actuaries -- which adds in lost productivity, employees on full disability and absenteeism -- puts the costs closer to $300 billion a year.

And at a minimum, the Congressional Budget Office predicts that per-person, obesity-related spending will increase an average of 3.6 percent a year, the report said.

The authors are asking those who make up budgets, including the Congressional Budget Office, to take into account a growing body of scientific literature on the toll of diabetes as well as hopeful interventions when they tally the price of obesity.

A window of 25 years will help policy makers arrive at more accurate long-term estimates, they said.

"Ten years is adequate for food stamps and aircraft carriers, but there are certain policy areas where we know the disease has a 20- to 25-year progression. You need the flexibility to go beyond 10 years," O'Grady said. "We probably want to modify the status quo of how we measure these things in order to capture the full value of that."

Marks said two of the greatest challenges the nation faces are restoring global economic competitiveness and the skyrocketing costs of medical care, which has become perhaps the biggest obstacle to long-term economic strength.

"Obesity lies right at the center of those challenges," he said. "The way Congress acts to score legislation, using only a 10-year horizon, misses a huge part of the value of preventive efforts."

The authors served in the George W. Bush administration. O'Grady was assistant secretary of Health and Human Services, and co-author James Capretta served as an associate director of the Office of Management and Budget.

A group of biologists from Denmark and the US led by Jakob Christensen-Dalsgaard, University of Southern Denmark, and Catherine Carr, University of Maryland, have shown that the turtle ear is specialized for underwater hearing. The new discovery is published in Proceedings of the Royal Society B March 21st , Special features of the turtle ear a large, air-filled middle ear and a movable tympanic disk increase its sensitivity for underwater sound. Laser measurements of disk vibrations in response to underwater sound show up to 100-fold larger vibrations of the disk than the surrounding water, most likely because the air volume resonates in an underwater sound field and drives the tympanic disk.

The tympanic middle ear is often seen as an adaptation to hearing in air, but the turtle tympanic ear is an anomaly here, because turtles are generally 100-fold less sensitive than other animals with eardrums, like mammals, birds and reptiles.

However, turtles are amphibious animals, and anatomical and biophysical studies by a group of biologists from Denmark and the US have shown that the ear of the red-eared slider is specialized for underwater rather than airborne sound.

CT scans, laser measurements from the ear under water and auditory evoked responses showed that the turtle ear was more sensitive for underwater than for airborne sound. The sensitivity is caused by the air filled middle ear. Resonance in the air cavity lined by the tympanic disc drives the disc and amplifies its vibrations up to 100 fold under water.

What the turtle is using its sensitive underwater hearing for is unknown. However, the sensitive hearing can be used for prey capture, predator avoidance and navigation under water. An alternative possibility is that turtles communicate by underwater sound. Underwater sound communication is unknown in the red-eared slider, but has recently been described in two other turtle species.
