I'm back!

After being gone for quite some time (I want to say it's nearing a year?), I've finally returned! Life's been hectic, I decided to go on and roleplay elsewhere for a length of time (No sense in lying about it), but I couldn't help but miss roleplaying and writing here. This is sort of a short announcement, but I can't really think of much else to say aside from shoot me a message!
I'm ready and eager to get plotting and roleplaying here again, so come at me with all you've got!

That's right, losers. I'm back.

Adkins explains Confederate flag earpiece

NEW YORK (AP) ? Trace Adkins wore an earpiece decorated like the Confederate flag when he performed for the Rockefeller Center Christmas Tree Lighting but says he meant no offense by it.

Adkins appeared with the earpiece on a nationally televised special for the lighting on Wednesday. Some regard the flag as a racist symbol and criticized Adkins in Twitter postings.

But in a statement released Thursday, the Louisiana native called himself a proud American who objects to any oppression and says the flag represents his Southern heritage.

He noted he's a descendant of Confederate soldiers and says he did not intend offense by wearing it.

Adkins ? on a USO tour in Japan ? also called for the preservation of America's battlefields and an "honest conversation about the country's history."

The Evolution of Remote Desktop Software | Personal Technology ...

The technology behind remote desktop software enables applications to be displayed locally even though they are run remotely on a server. That is, this kind of software acts as a kind of ?remote control? of computers, connecting a laptop or computer to another device via the internet or yet another network, and permitting desktops to be taken over and controlled by outside administration.

As broadband internet connections became increasingly offered across the world, the require and desire for remote access technology arose. With this software, men and women became able to control any personal computer at any location in the world, as long as they had been connected with this technology.

?

Windows invented remote desktop protocol in 1999-2000 and, beginning with Windows XP, each and every Windows version has included remote desktop protocol. The require for remote desktop software arose with the transition from in-individual services to long-distance, frequently outsourced services. Remote control software was originally utilised at IT help and consumer service desks so that professionals could control customers? computers and support them with any technical difficulties.

?

Right now, remote desktop software program is not only utilized by tech experts, but is also used by the average computer user for file sharing, by businesspeople for working on documents outside of the office, and by educational institutions to permit communication between quite a few students across the world.

?

As broadband world wide web access becomes even a lot more readily accessible across the world, and as individuals grow to be far more dependent upon computer communications, pc remote access software program will likely play an even larger role in the world, and open up endless opportunities for communication, education, efficiency, and productivity.

New Year's Fitness Resolutions: A Sport Psychers' Perspective ...

New Year?s Fitness Resolutions: A Sport Psychers??Perspective

I?ve recently been asked for tips on making attainable and sustainable New Year?s fitness resolutions, as part of a story for inclusion within a lifestyle website.? Bullet-pointed ?must-do?s? seem a simplified and perhaps sophomoric way to approach the topic of exercise adherence.?? The truth is, headlines sell: ?5 Simple Tips for year-long fitness maintenance!? and ?Make those New Year?s resolutions stick!? would likely yield more clicks than ?Let?s address your motivational climate and perception of control?.? Neat titles sell.? Acknowledging the need for sell-ability, I?ve put together, quite neatly and consumer culture-friendlily, 5 tips that may enhance the likelihood of sustained physical activity.? And for your consumption before December, no less!? You?ve a full month to digest before putting it into action.

?

  1. I?ll start with a personal anecdote: an older man, approaching the 50th wedding anniversary with his wife, recently confessed to me, a newly married man at the time, his secret to marital success: ?Keep her guessing. Keep her on her toes. One day, return home from work with a rose, or a nice shirt, or a piece of jewelry, or a loving embrace. Never fall into a long-term routine. The possibility of surprise fortifies the relationship, and keeps it lasting?.? While this is phenomenal relationship advice, it got me thinking of its relevance with exercise.? The human body & mind both respond most favorably to regimens that promote variation; life requires a bit of change to keep someone alert, fresh, and to keep one?s interest peaked.? So, keep the body & the mind guessing, keep the activities fresh & creative.? Continually challenge your body by switching up your routine every so often, say, every 2 months.

    2. Set realistic goals.? People tend to underestimate the difficulty of incorporating exercise into their lives, and tend to overestimate the immediacy of bodily change.? When one thinks, ?I?ll start exercising 6 days a week, and will lose 15 pounds by Valentine?s Day,? it?s an unsustainable recipe for disaster.? Physical and mental change takes time.? When, by Valentine?s Day, the weight isn?t off and exercise is only being performed biweekly, one?s self-efficacy and drive to continue trying weakens.? Start with a more realistic expectation if you?re unaccustomed to setting fitness goals, like incorporating exercise only 2 or 3 days per week for a realistic period of time, like 20 minutes, giving yourself space to progress.? And leave the outcome-oriented and essentially uncontrollable expectations (like how much weight one wants to lose) on the shelf.? What is under the power of our own control is what we eat, how we move, how we think, how we respond to waves of fatigue or laziness.? Understanding that patience is necessary, and keeping one?s focus on the ?controllables?, is helpful.

    3. The benefits of activity throughout the day were demonstrated in a study about fidgeting a few years back. Fidgeting has been linked to leanness and the lack of it to being overweight. Just being restless ? standing, pacing, toe tapping ? can burn about 350 calories a day, the study said. That can add up to 30 or 40 pounds per year. ? The novel ways that people fit exercise into their lives tend to be convenient as well as slimming. Jogging or walking briskly between errands, yoga in the shower, and, yes, varying levels of romantic intimacy are all ?fidget-based? (i.e. non-formal) workouts.? Whatever it is, you want your exercise and physical activity to be fun and engaging ? that?s most important.

    4. Ask yourself, ?Why??? The reason you engage in exercise is significant.? The most powerful motivator comes from within, or intrinsically: this is when an exerciser participates in an activity for the inherent pleasure of doing so, because it?s their personal choice (to feel good, to be healthier, for the enjoyment of the activity).? When we work out for intrinsic reasons, we gain feelings of self-control; we do it for us; we determine our own behavior; we?re enjoying the moment because it?s fun.? Those who are motivated extrinsically ? driven by a desire to look like Fitness Magazine?s Miss July, to gain attention or receive external rewards, or for an ego boost ? engage in exercise as a means to an end, to obtain something they want or to avoid realizing something they don?t desire.? Those who adopt intrinsic motivators better maintain & adhere to exercise regimens.? Remember ?why?, every day.

    5. The implications to lots of research are that rather than educational strategies, like teaching time-management skills, programs aiming at changing behavior and teaching techniques geared toward changing attitudes and perceptions of the role of exercise and changing one?s thoughts about exerciseis more impactful. Rather than dedicating energy figuring out how to carve out the appropriate time for exercise ? which itself is exhausting ? engage in some self-reflection and determine how you feel & think about exercise, and what healthier alternative approaches or attitudes you?re willing to adopt.

?

Happy New Year.

Navy Veteran Finds Business Success with Meineke Car Care Center

Decorated veteran named finalist for national award.

Pensacola, FL (PRWEB) November 29, 2012

Navy veteran Tom Perez purchased Meineke Car Care Center in Pensacola, Fla., in May with the help of Boost A Hero, a crowdfunding site to help veterans open franchises. Perez raised $6,740 through Boost A Hero, and Meineke discounted the franchise fee and provided additional financing, making it possible for Perez to take over the Pensacola location.

In his first six months in business, Perez, 31, has hired five veterans, keeping his promise to help other veterans find jobs. He has also increased sales for his location by 60 percent, and he hopes to open a second center. Perez has been nominated for the International Franchise Association (IFA)?s Veteran of the Year award and is a finalist for the U.S. Chamber of Commerce?s Hiring Our Heroes award.

?When I was forced to leave the Navy after 10 years of service due to downsizing, I tried to find a job as a police officer. I had served as master of arms and was a decorated veteran, but I couldn?t find a job,? Perez said. ?I looked into opening a franchise and Meineke was clearly a great franchise opportunity. The skills I learned in the military have been a key part of my success, and I?m looking forward to continuing to grow my business. As I grow, I?ll be able to hire even more veterans, which is something that is important to me.?

Perez completed four tours in Iraq and many tours in other locations. He received four Navy/Marine Corp Achievement Medals, the Defense Meritorious Service Medal, the Joint Service Achievement Medal, the Navy Unit Commendation, Meritorious Unit Commendation, three Good Conduct Medals, the National Defense Medal, the Iraq Campaign Medal, the Global War On Terrorism Service Medal, the Global War On Terrorism Expeditions Medal and the Outstanding Volunteer Service Medal.

?We are incredibly proud of all Tom has accomplished in his first six months as a Meineke Car Care Center franchisee,? said Dave Schaefers, vice president of franchise development for Meineke. ?Meineke has always been committed to helping veterans become franchise business owners, and we have incentivized more than $750,000 in VetFran discounts over the years, making us one of the top VetFran companies in the franchising community. Tom speaks volumes about the capabilities that veterans bring to small business. He is the perfect example of a veteran who needed help finding the capital to open a business only to become an amazing entrepreneur. We?re so happy for Tom and his wife, Jaylene, and we?re proud to have them in the Meineke family.?

Meineke is owned by Driven Brands, the parent company to six automotive franchises. Other Driven Brands companies include Maaco (collision repair and auto painting), Econo Lube N? Tune (automotive repair/quick-lube services), and Drive N Style (automotive paint repair, vehicle reconditioning, protection and appearance maintenance, and aftermarket installation services), as well as Tortal.net, a training company that specializes in developing interactive online training solutions. Beasley Firm Sponsors Philadelphia Mob Trial Blog By George Anastasia

The Beasley Firm sponsors BigTrial.net, featuring award-winning journalist and veteran mob reporter George Anastasia covering the criminal racketeering case against Joseph Ligambi and his associates.

Philadelphia, PA (PRWEB) November 28, 2012

The Beasley Firm is proud to again sponsor a veteran journalist covering a major trial. The Philadelphia Mob Trial Blog features award-winning journalist George Anastasia doing what he?s done best for thirty-five years: covering organized (and disorganized) crime, this time from within a federal courtroom on Market Street, where reputed mob boss Joseph ?Uncle Joe? Ligambi and six associates are on trial for criminal racketeering.

The Blog was inspired by the runaway success earlier in 2012 of the Philadelphia Priest Abuse Trial Blog, in which The Beasley Firm sponsored veteran journalist Ralph Cipriano?s daily dispatches from the child endangerment and conspiracy trial against Msgr. William J. Lynn, the first Catholic Archdiocese official criminally prosecuted for charges relating to covering up sex abuse within the church. That blog quickly became the go-to source both for abuse victim advocates and for defenders of the church, attracting national media coverage and more than 250,000 readers ? all to read about a single trial.

Said Beasley Firm managing partner Jim Beasley, Jr., ?we had a tremendously positive response to Ralph's blog, with thousands of people thanking us for taking them inside the courtroom. There are a lot of people out there yearning to know more about what really happens in our justice system, to get into the nitty-gritty of trial and to see a no-nonsense perspective on real cases, and nobody is better suited than George to put the public front-and-center in a mob trial.?

For years, George Anastasia covered the crime and Mafia beat for The Philadelphia Inquirer, and he?s the author of five books, including ?The Last Gangster? (ReganBooks/Harper Collins, March 2004), a New York Times bestseller that chronicled the demise of the Philadelphia mob. He is the recipient of numerous awards for writing and reporting, including a Sigma Delta Chi from the Society of Professional Journalists, one of the premier awards in journalism.

Jim Beasley continued, ?we believe it is our duty as lawyers to educate the public on the inner workings of the law, and we?re proud to be on one of the new frontiers in journalism.? The Beasley Firm plans to use this model in the future with other journalists and types of trials, hosted on the BigTrial.net site.

Since 1958 The Beasley Firm?s Philadelphia lawyers have fought for the rights of injured persons. Focusing on personal injury, medical malpractice, product liability, and wrongful death lawsuits, The Beasley Firm?s clients have been awarded billions of dollars in compensation, including compensation for victims of crimes and terrorist attacks. In Smith v. Republic of Iraq, The Beasley Firm obtained a $104 million verdict against Republic of Iraq, al-Qaeda, Osama bin Laden, the Taliban, and the Islamic Emirate of Afghanistan on behalf of family members who lost loved ones in the September 11, 2001 attacks.

Bin Laden movie based on controversial first-hand accounts

It was the greatest manhunt of all time, the stealthy nighttime raid by the elite SEAL Team Six on Osama bin Laden's compound in Pakistan, which led to the death of the world's most wanted terrorist leader.

It is the subject of "Zero Dark Thirty," a riveting new film by director Kathryn Bigelow and screenwriter Mark Boal, both of Oscar-winning "The Hurt Locker" fame. But when they began making a film about the hunt for bin Laden six years ago, right after they finished "The Hurt Locker," the movie they had in mind was about the failed attempt to find bin Laden in the Tora Bora mountains of Afghanistan.

That plan changed drastically on May 1, 2011 when bin Laden was killed. Boal, a meticulous investigative reporter, picked up the phone and started working his sources.

"It was a thrilling journey to go on and also thrilling to discover what the people who were involved in this mission were really like," Boal said.

In an exclusive interview with "Nightline," Bigelow and Boal talked about bringing "Zero Dark Thirty" to the screen based on Boal's interviews and Bigelow's dramatic vision.

"It was all based on first hands accounts so it really felt very vivid and very vital and very, very immediate and visceral of course which is very exciting as a film maker," Bigelow said.

Watch ABC's Martha Raddatz's exclusive interview with Kathryn Bigelow and Mark Boal on "Nightline" tonight at 11:35 p.m. ET

Bigelow said she and Boal were working in his office when they heard President Obama's now famous announcement that the United States had "conducted an operation that killed Osama bin Laden."

"It was a personal moment for me because I grew up in New York City," Boal said. "I think for a lot of people, just kind of an overwhelming moment."

All of a sudden, Bigelow said it put their project in a very different perspective.

"It was not just as a film concern, it was kind of a global concern," she said. "We both realized simultaneously that we had to pivot."

"I picked up the phone and started calling sources and asking them what they knew and taking referrals and knocking on doors and really approached it as comprehensively as I could," Boal said.

Almost immediately, the filmmakers found themselves in the middle of an election year firestorm, accused of receiving classified documents to bolster the president's role. It's something they both deny.

"I certainly did a lot of homework, but I never asked for classified material," Boal said. "To my knowledge I never received any."

In fact, President Obama makes only a fleeting appearance in the film. The star of this real-life drama is, surprisingly, a young female CIA officer, played by Jessica Chastain, who helps find bin Laden through a long-forgotten courier.

"It was a couple of months into the research when I heard about a woman, part of the team, and she has played a big role and she had gone to Jalalabad and been deployed with the SEALs on the night of the raid," Boal said.

"When I realized at the heart of this hunt, at the heart of this 10-year odyssey was this woman, this young woman who had a kind of tenacity and a dedication and a courage, she would never say no, I was excited to take it on," Bigelow said.

The Story Behind "Zero Dark Thirty"

Both Bigelow and Boal felt a responsibility to accurately portray the lives of the people who normally work in the shadows, their efforts rarely known to the outside world. While some of the dialog is word for word real, based on interviews with the young CIA officer and others, some of the dialog is dramatized and the decade-long narrative of events condensed.

"They were proud of what they had done, but they had more or less resigned themselves to the fact that what they had done is not something they could talk about publically," Boal said. "But one of the things a movie allows people to do is talk in a way that is a little bit freer because they know that movies can change the way people look, [and] that I don't have quite the same standards of having to reveal sources as I would if I was, let's say, running a front page piece in the New York Times."

The climax of the film is, of course, the raid that killed bin Laden. The scene was a challenge for the filmmakers who were presenting it to a world that knew how it ended.

"But they don't know how it happened," Bigelow said. "They don't know, OK what was the choreography of the assault itself, where did they land, where did they crash, who did they kill first?"

Although it only takes up about one-fifth of "Zero Dark Thirty" -- the title comes from the code for SEAL team's landing time of 12:30 a.m. -- the filmmakers said the assault on bin Laden's compound, like the rest of the film, is as accurate as possible. A full scale version of the compound -- no Hollywood facades for this movie ? was built in Jordan, where they shot for almost four weeks. The floor, the tile, the carpet, the furniture and the marks on the walls, were copied from images seen in ABC News footage that Bigelow said they reviewed frame by frame.

And the famous stealth helicopters that swept over the border into Pakistan were real Black Hawks with computer generated graphics replicating the stealthy skin. Bigelow said the actors told of the terrifying and challenging conditions their real-life counterparts faced.

"You are in the elements, you are in the wind, you are in the sand, the sound of the rotor wash and you can't see anything. So you imagine what it would be like to land in this place," she said.

And Bigelow takes viewers beyond the clinical news accounts, the soundless descriptions and even though you might think you know how it ends, there is more to the story.

"For both of us I think it's fair to say the story itself and the making of it was really hard but really thrilling and exciting," Boal said. "Because you are at the center of something that is so epic and that doesn't come along very often and I think we were both aware of the fact that we probably won't have another story like this."

"I can't imagine," Bigelow said. "I think it's the story of a lifetime."

Fed's Lockhart warns of unusual threats to financial system

BERLIN (Reuters) - A top Federal Reserve official warned on Tuesday of potential risks to financial stability from cyberattacks on the U.S. payments system and from a looming funding gap in public pensions.

In a speech to a conference in the German capital, the president of the Atlanta Federal Reserve, Dennis Lockhart, said that at a global level the span of vigilance needed to be extremely broad.

"Our radar should scan widely - beyond the most obvious sources of risk," said Lockhart, according to the text of his speech, arguing that markets viewed by some as too small to cause much trouble before the 2008 crisis had ended up posing systemic-scale problems.

Homing in on the issue of cyber-security, he said the fragmented nature of the U.S. payments industry and its rapid evolution were creating many areas of vulnerability.

"A real financial stability concern, however, is the potential for malicious disruptions to the payments system in the form of broadly targeted cyberattacks," he said.

He argued that they should now probably be viewed "as a persistent threat with potential systemic implications".

Although they were unlikely to have as deep or long-lasting an impact on financial system stability as fiscal crises or bank runs, Lockhart said the potential attacks provided justification for collaborative attempts to take preventative measures.

Another growing concern is a potential funding gap in public pensions, Lockhart said, adding that this would more likely appear as a "gradually accreting threat to growth" than as a single event shock.

"As a financial stability consideration, the problem of pension underfunding is not likely to be the source of any immediate shock or trigger a broader systemic crisis," he said.

"However, the situation needs to be monitored as public finance does contribute to financial and economic stability more broadly."

bLAWgazine: The benefits and burdens of construction liens | Bullet ...

Quinn Ross is one of eight lawyers at The Ross Firm. Quinn practises in the areas of real estate, corporate/commercial law and estate law. He also has broad experience in criminal, administrative and civil litigation where he has appeared before the Ontario Court of Justice, the Ontario Superior Court of Justice, the Divisional Court of Ontario, the Court of Appeal for Ontario and various administrative tribunals.

?

Construction liens can be a colossal headache if you discover that a lien has been registered against your property.

Typically, a construction lien is registered by a person or company who has supplied materials or services to a construction job and asserts that they have not been paid for the materials or services supplied.

Practically, this means that if you were building your dream home and relying on mortgage money to finance the project, the mortgage money would stop dead until the lien was lifted. ??Similarly, trying to sell a property subject to a lien is next to impossible as the lien runs with the land and becomes the problem of any subsequent owner.

Some people in the construction industry slap liens on job sites without considering the law. Moreover, property owners often respond to the liens as if there was an automatic right to have the lien tie up their property.

The fact is, legally, construction liens are considered an extraordinary remedy.? There is no absolute right to throw a lien on a property.? The registration of a construction lien is a privilege, not a right.

Certain precise conditions of fact and time must be met, failing which a judge has the power to vacate and or discharge the lien on motion, without a full hearing of the claim giving rise to the lien. An improperly placed lien can result in significant damages against the contractor/subcontractor once the lien is lifted and could moreover preclude the contractor/subcontractor from the appropriate protection in the event their account was unpaid for no good reason.

If a lien is placed on your property it may be that a simple application to court can have it removed rather than the time-consuming and expensive process of an all-out trial.

Also, if you are thinking about placing a lien on a property, it is important that it be done in a timely fashion and in a way that complies with the legislation. Time is your big enemy when considering a construction lien.

Lesson to be learned?

Construction liens are complex and fraught with pitfalls if undertaken by inexperienced parties.? If one isn?t absolutely sure of the steps, timing and tests required to be met in registering a lien, the best advice is to get advice.

Giants demolish Packers, end November skid

Manning throws 3 TD passes as New York wins first game in the month

By BARRY WILNER

updated 11:30 p.m. ET Nov. 25, 2012

EAST RUTHERFORD, N.J. - Adam Merchant had a wish and a command for the New York Giants.

The 15-year-old fan from Barre, Vt., attended practice and then Sunday's game with the Packers thanks to the Make-A-Wish Foundation. He wanted the Giants to snap their two-game slide and get out of their offensive funk.

So he ordered the Giants to "play like world champions," and they delivered a 38-10 rout of the Green Bay Packers.

"That was the theme of our meetings," coach Tom Coughlin said.

Eli Manning came back from the bye week with a rested arm, and that offensive slump was tossed aside. The Giants (7-4) said they turned things around for themselves, and for Merchant, who has cancer.

"They have one wish," Manning said after throwing for three scores to set a team record with 200 TD passes for his career. "It is sad when you think about it - they have one wish, what you want to do, and he wanted to come to Giants practice ... and to a game.

"He said, `Go show everybody you are the world champions and why you are the world champions and play that way.' Everybody got fired up and played the way we know we can."

The Packers (7-4) certainly did not. The showcase game was decided early as the Giants outscored the Packers 31-10 in the opening half to end Green Bay's five-game winning streak. While New York took a two-game lead in the NFC East, Green Bay fell out of a tie with Chicago atop the NFC North.

The Packers were missing such key starters as linebacker Clay Matthews, defensive back Charles Woodson and receiver Greg Jennings, and it showed. After being manhandled in last season's playoffs by the Giants, who went on to win the Super Bowl, the Packers weren't much more competitive this time. Aaron Rodgers was sacked five times, including twice by Mathias Kiwanuka, who spent much of the game at defensive tackle rather than in his usual linebacker spot.

"When your quarterback is under pressure like that, it affected me tonight," coach Mike McCarthy said of his play-calling. "I probably didn't call the best game I've called. You have to protect your quarterback. It's your No. 1 responsibility. That's not what we're looking for."

New York's balanced attack was guided by Manning, who had his first strong game in a month with 249 yards passing.

"I never thought my arm was tired, never felt like it," Manning said. "After a week off, you come back to practice, it felt good, alive, balls coming out with a little pop on it.

"After 10 weeks, it definitely needed a little rest."

Coughlin knew Manning would return with some extra verve.

"There was no doubt he was going to come back and play well," Coughlin said. "I think the rest really helped him. ... Eli said he felt as if he was coming back for the start of the season. I was very confident he would come back and be Eli."

Ahmad Bradshaw gained a combined 119 yards and scored a touchdown. He had the first big play of the night to begin the offensive onslaught.

New York struck early with a brilliantly conceived screen pass to Bradshaw off a fake reverse to Victor Cruz. Bradshaw sped down the field before being caught at the Green Bay 2, a 59-yard pickup that led to Andre Brown's scoring run.

Brown later broke his leg; Coughlin did not say which leg after the game.

"It will be a tough loss, he is an important player," Manning said.

Green Bay didn't flinch, with Jordy Nelson getting behind Corey Webster in single coverage down the right sideline for a 61-yard TD reception from Rodgers.

The scoring flurry went back in the Giants' favor - and pretty much stayed there - when Manning hit Rueben Randle in the back of the end zone for a 16-yard TD. It was the first score for the rookie and Manning's first touchdown throw in four games, and he set it up with, of all things, a scramble in which he laid his shoulder into Packers cornerback Tramon Williams for a 13-yard gain.

"It sparked our sideline," Coughlin said. "It would not be the recommended way. To see him do that kind of sent the message to the rest of our team: Whatever you have to do to succeed, do it."

Webster's interception led to Lawrence Tynes' 43-yard field goal late in the first quarter for a 17-7 lead, and the Giants weren't nearly done. Manning's 9-yard connection with Cruz tied him for the club record with 199 TD passes, and after Osi Umenyiora's strip-sack of Rodgers was recovered by Jason Pierre-Paul at the Green Bay 23, Bradshaw scored from the 13.

The 31 points were the most New York scored in a half all season and nearly equaled the 33 it scored in its two losses before the bye.

And the Giants had more offense in them. Manning threw his 200th TD pass to move ahead of Phil Simms, a 13-yarder over the middle to Hakeem Nicks, who stretched the ball over the goal line as he was tackled.

"There was a different enthusiasm in practices," Manning said, "and I think that paid off in the game."

It paid off for the Giants, and for their young fan.

"It kind of hit home," Justin Tuck said. "You got this kid that don't know us from James and watches us on TV every Sunday and it's so profound."

NOTES: The Giants lost safety Kenny Phillips with a knee injury in the third quarter. He was making his first appearance since Week 4, when he was sidelined with a knee problem. ... Giants right tackle David Diehl sustained a stinger in the first half. ... Green Bay lost safety M.D. Jennings (rib), DE C.J. Wilson (knee), and RB Johnny White (concussion). ... Rodgers was 14 of 25 for 219 yards, one TD, one interception and one lost fumble.

Families of inmates who died at the Orleans Parish jail advocate for ...

They come clutching framed photographs of their loved ones in their best moments: wearing a broad smile at a wedding or posing in full military garb. But the stories they tell don't have happy endings.

Each ends at Orleans Parish Prison. Michael Hitzman and William Goetzee committed suicide, both while they were supposedly under observation by deputies. Cayne Miceli stopped breathing while trying to get out of 5-point restraints, later dying at the hospital. The exact causes of Tracy Barquet Jr.'s death are unknown, but, like Miceli and Goetzee, he died while in the care of the jail's psychiatric unit.

Their family members have unfurled the grim details of these deaths in sit-down meetings with five of the seven New Orleans City Council members and Mayor Mitch Landrieu. All unlikely advocates, several members of the group have become regular attendees at City Council meetings on the jail and its budget.

Their aim is to put a human face on the jail's most troubling statistic: the 38 inmate deaths that have occurred since Hurricane Katrina. But they also are trying to push the city to get on board with a massive overhaul of the jail, a reform that will likely be outlined in a federal consent decree mandating scores of changes in how Orleans Parish Sheriff Marlin Gusman runs his facilities.

"I'll be tormented and tortured every day of my life," said Donna Gauthier, who was engaged to Goetzee before he killed himself in the jail last year. "We thought it was a safe haven. He was getting whatever help he needed."

Sophia Becker, Miceli's sister, said the fact that others lost relatives after her sister's death in January 2009 makes her skeptical about the the prospects of reform under the current leadership. "It is very angering that more families are being affected," she said.

Fixing the mental health care provided by the jail -- which the U.S. Department of Justice has called profoundly inadequate in investigations from 2009 and earlier this year -- is expected to be a key component of a consent decree. In federal court filings, the Justice Department has characterized the settlement as near completion. But negotiations last month hit an impasse over how to pay for the upgrades.

While Gusman has said he supports a decree, he insists one will be possible only if the city puts more money into his operations. Attorneys for the city have scoffed at that contention in court filings, saying there is no evidence that the problems at the jail stem from insufficient funding.

U.S. District Court Judge Lance Africk in October appointed a retired criminal court judge, Terry Alarcon, to try to get the two sides to come to an agreement. The next status hearing is scheduled for Tuesday.

James Hitzman, whose son Michael hanged himself inside a Central Lock-Up cell, noted that the city has found money for a similarly broad consent decree to remake the New Orleans Police Department.

"They should be able to find that money somewhere. If things are not fixed under supervised conditions, things will not change," he said. "It is evident they can't do it on their own."

Civil rights attorney Mary Howell, who represents the four families that have become advocates of reform, said she understands the city's skepticism about simply forking over more money. For years, mayoral administrations and successive sheriffs tangled over how much money is needed to properly run the jail, but never really came up with a satisfactory answer. Now is the time to look to other cities and figure it out, she said.

"I do think it is correct that the city should not be writing a 'blank check,'" Howell said. "What they need to do is insist on transparency and accountability. The situation needs to be audited and monitored."

Each of the four deaths -- which occurred under circumstances that Howell characterized as, at minimum, "very questionable" -- highlights significant, systemic problems at the jail, she said. Hitzman's wife and children filed a lawsuit against the sheriff's office, which was settled. Lawsuits in the Miceli and Goetzee cases are still pending.

In a statement, Dr. Samuel Gore, the sheriff's medical director, defended the jail's record, saying the jail's mortality rate is below the national average, while the suicide rate is just slightly above the national average and compares favorably to cities like Baltimore, Oklahoma City and Phoenix.

Gore said his staff takes steps to identify medical and psychiatric problems during the booking process, as well as analyzing each inmate death to see what caused it and what shortcomings it points up. He noted that the jail population is a challenging one.

"We encounter individuals daily with untreated or undertreated medical conditions, as well as an increasing number of untreated, undiagnosed or undertreated mental health disorders," Gore said.

But investigators from the Justice Department found that conditions at the jail are unconstitutional. The department detailed problems with how inmates are classified, the levels of violence between inmates and by guards, as well as lack of support for inmates who don't speak English. The agency also repeatedly flagged mental health care as deficient, in particular saying the treatment of suicidal inmates is inhumane.

Miceli's case was highlighted in the first Justice report as an example of how the sheriff staff "fails to protect inmates from harm while in restraints." Miceli was put in five-point restraints - a sort of harness that pins a person down -- after she allegedly attempted suicide in an isolation cell. An asthmatic, Miceli complained about not being able to breathe and eventually tried to get out of her restraints. She collapsed as deputies tried to put her back in them. Miceli had no pulse for about 35 minutes, according to a federal lawsuit, but was revived by CPR. She later died at the LSU hospital when taken off life support.

More recently, an April 2012 report noted that "deficient monitoring" contributed to both Hitzman and Goetzee's deaths. Their suicides were also used as examples of the jail's allegedly inadequate mental health screening.

During his screening, Hitzman admitted to recently swallowing drugs. After acting erratically, he was placed in an isolation cell equipped with a video camera. However, it appears nobody watched the camera's video stream, as no sheriff employee intervened when Hitzman hanged himself with his shirt.

Goetzee, a longtime U.S. Coast Guard employee and commander in the reserves, had been arrested in August 2011 after he tried to grab a gun from a federal security officer outside court. During the struggle, Goetzee said, "I want to kill myself. Give me your gun," to the officer, according to a complaint filed at federal court.

Goetzee had been seeking treatment for his mental troubles, which grew out of work exhaustion and a serious car accident.

Despite this history -- and though he told jail screeners about his suicidal thoughts -- the Justice Department found that Goetzee was initially kept in the general population before being sent to the Interim LSU Public Hospital. After he was returned to OPP, Goetzee was placed on suicide watch.

Goetzee committed suicide while in the jail's suicide tank. He was supposed to be under direct observation, but deputy William Thompson left his post, giving Goetzee time to swallow enough toilet paper to suffocate himself.

Gore pointed to this case as an example of the sheriff's office holding itself accountable, noting that Thompson this year pleaded guilty to criminal charges of malfeasance in office. But Gauthier said the result was unsatisfying, as it appears no supervisors were disciplined for the obvious lapse in protocol.

Most recently, in a federal court filing, the Justice Department noted that Tracy Barquet Jr. died in 2010 days after he was beaten and pepper-sprayed by guards. Barquet's death remains classified as "undetermined" by the Orleans Parish coroner.

Gore noted in his statement that the coroner did not find any "indications of any physical confrontations that would be fatal, nor did the coroner find any signs of suicide" in Barquet's death. According to jail records, a deputy was disciplined for spraying pepper spray at Barquet through the cell bars. While inmates said Barquet was beaten, deputies denied it.

For Tracy Barquet Sr., his 25-year-old son's death continues to raise unresolved questions more than two years later. Barquet acknowledged his son had a drug problem, but said he'd never had a previous history of seizures, one potential cause of death posited by the coroner's office. The events leading up to his son's death - including the alleged beating and pepper-spraying days before it - are troubling, he said.

"I just want some answers," Barquet said. "We did know he was ingesting drugs. He had a problem with that. I thought by him being in there he would be able to detox. That he was safe."

Howell said the deaths point to the need for outside investigations. She has asked Orleans Parish District Attorney Leon Cannizzaro to consider investigating all deaths at the jail. She also noted that Gusman, before he was elected, had pledged to hire an independent monitor, but never followed through.

While the coroner hasn't found evidence of foul play to rule Barquet's death a homicide, an outside probe could determine whether there was negligence or malfeasance on the part of jail staff, she said.

Cannizzaro said he doesn't have the resources to look into deaths at the jail and must rely on the sheriff's office to investigate itself. When a case is brought to the office, whether by Gusman or a victim's advocate like Howell, his staff reviews it, he said.

Gusman has been cooperative when the district attorney asks for files, he noted.

In a statement, Gusman reaffirmed his support for a monitor, saying such a position could "play a productive part of the future of the sheriff's office." The statement did not say why he has never moved to hire one.

Knight Capital in talks for sale of market-making unit: WSJ

(Reuters) - Knight Capital Group Inc is in talks about possibly selling its market-making operation, its largest and most profitable business, the Wall Street Journal reported, citing people briefed on the discussions.

The securities firm has been approached by at least two rivals about its market-making operation, which uses complicated computer models to match buy and sell orders in stocks and options.

Knight's board of directors is expected to get separate proposals next week for the market-making business from high-speed trading firms Getco LLC and Virtu Financial LLC, the Journal reported, citing the people who were briefed. Other potential buyers also could approach the board about that business and perhaps others.

Getco and Virtu spokespeople declined comment on the report. A Knight spokeswoman was not immediately available for comment.

The unit had $663.8 million in pretax profits from 2009 to 2011 but suffered a loss of $400.9 million in this year's first nine months because of a software glitch that flooded the market with errant trades on August 1.

Black Friday creeps into Thanksgiving permanently?

This season could mark the end of Black Friday as we know it.

For decades, stores have opened their doors in the wee hours on the day after Thanksgiving. But this year, major chains such as Target and Sears ushered in customers on Thanksgiving itself, even before the turkey leftovers had gotten cold, turning the traditional busiest shopping day of the year into a two-day affair.

Despite an outcry from some employees, both stores and shoppers seemed to like it. Some people went shopping with a full belly, going straight from the dinner table to the stores. Others slept off their big meal and went to the mall before daybreak on Black Friday.

"I ate my turkey dinner and came right here," said Rasheed Ali, a college student in New York City who bought a 50-inch TV for $349 and a sewing machine for $50 when Target opened at 9 p.m. on Thanksgiving. "Then I'm going home and eating more."

This new approach could become a holiday shopping season tradition.

"It's Black Thursday and Friday combined," said Jackie Fernandez, a retail expert at the consulting firm Deloitte. "This is going to be a new normal of how we shop."

It won't be clear for a few days how many shoppers took advantage of the Thanksgiving hours. But about 17 percent of people said earlier this month that they planned to shop at stores that opened on Thanksgiving, according to an International Council of Shopping Centers-Goldman Sachs survey of 1,000 consumers.

Meanwhile, 33 percent intended to shop on Black Friday, down 1 percentage point from last year. Overall, it is estimated that sales on Black Friday will be up 3.8 percent to $11.4 billion this year, according to technology company ShopperTrak, which did not forecast sales from Thanksgiving Day.

The Black Friday creep began in earnest a few years ago when stores realized that sales alone weren't enough to lure shoppers, especially with Americans becoming more comfortable buying things online. Opening on Thanksgiving was risky, with some employees and shoppers complaining it was almost sacrilegious.

But many stores evidently felt they needed an edge, especially this season, when many Americans are worried about high unemployment and wondering whether Congress will be able to head off tax increases and spending cuts before the U.S. reaches the "fiscal cliff" in January.

Overall, the National Retail Federation estimates that sales in November and December will rise 4.1 percent this year to $586.1 billion, below last year's 5.6 percent.

"Every retailer wants to beat everyone else," said C. Britt Beemer, chairman of America's Research Group, a firm based in Charleston, S.C. "Shoppers love it."

At Wal-Mart, the world's largest retailer, most of its 4,000 U.S. namesake stores are already open 24 hours year-round. But the chain added special sales at 8 p.m. on Thanksgiving, two hours earlier than a year ago.

The company said that its start to the holiday season was "the best ever," with nearly 10 million transactions and 5,000 items sold per second from 8 p.m. to midnight on Thanksgiving.

Toys R Us opened at 8 p.m. on Thanksgiving, an hour earlier than last year.

Macy's, which opened at midnight on Thanksgiving, had 12,000 customers wrapped around its store in New York's Herald Square.

The earlier start also meant the violence associated with shoppers fighting for bargains likewise began earlier. On Thanksgiving night, a couple was struck by an SUV while walking into a Wal-Mart in Washington state, and in Texas, a fight broke out when a man tried to cut the queue at a Sears store in San Antonio. Two people also were shot and wounded in Tallahassee, Fla., in a disagreement that police believe was over a parking spot outside a Wal-Mart.

Julie Hansen, a spokeswoman at Minneapolis' Mall of America, the nation's largest shopping center, reported that 30,000 shoppers showed up for the mall's midnight opening, up from 20,000 last year. "This was additional dollars," Hansen said. This year, 200 of the 520 mall tenants opened at midnight following Thanksgiving. That's double from a year ago.

To be sure, it's not clear whether the longer hours will turn into extra dollars for retailers, or whether sales will simply be spread out over two days.

The Thanksgiving openings appeared to create two waves of shoppers ? the late-nights and the early birds.

Sam Chandler and his wife, Lori, were among the night owls. They started shopping at midnight on Thanksgiving. By the time they reached the Wal-Mart in Greenville, S.C., early Friday, they had already hit several stores, including Target and Best Buy.

"We've learned over the years, you have to stand in line early and pray," Sam said.

Stu and April Schatz of Rockland County, N.Y., went to the Garden State Plaza mall in Paramus, N.J., which didn't open until 7 a.m. on Black Friday, because they didn't want to deal with the crowds that show up late on Thanksgiving night.

"It's so much more civilized going in the morning," said April Schatz, a teacher. "We wanted to enjoy our evening."
