PORT MORESBY, Papua New Guinea ? Rescuers plucked more than 230 survivors from the sea off Papua New Guinea's east coast after a ferry sank Thursday with as many as 350 people on board, officials said.

An airplane from Australia, three helicopters and eight ships were scouring the search area after the MV Rabaul Queen went down around dawn while traveling from Kimbe on the island of New Britain to the coastal city of Lae on the main island, Australian Maritime Safety Authority said in a statement.

The ferry sank 50 miles (80 kilometers) east of Lae, the South Pacific country's second-largest city, and 10 miles (16 kilometers) from shore, the statement said.

Papua New Guinea Prime Minister Peter O'Neill said the cause of the accident was unknown.

He said more than 300 people were aboard the ship, although the precise number had yet to be confirmed.

Australian Broadcasting Corp. quoted police in Kimbe, where the ferry sailed from, as saying most of the passengers were students and trainee teachers.

The Australian authority's dedicated search and rescue airplane based in the northern city of Cairns had reached the scene by afternoon and another two Australian airplanes were on their way.

The authority's spokeswoman Carly Lusk said the crew of the first airplane threw several life rafts to survivors in the water.

She did not know whether the search would continue into the night.

In the hours just after the sinking, Australian Prime Minister Julia Gillard called the incident a "major tragedy."

"Given the likely very high loss of life here, I think when this news comes to the attention of Australians around the country they will be thinking about the people of PNG as they respond to this tragedy," she added.

The Australian maritime agency initially detected the ferry's distress beacon and alerted the PNG Maritime Rescue Coordination Center, which is coordinating the rescue effort. Lusk said 238 survivors had been recovered by late Thursday.

She said 350 people were believed to be on board, but Papua New Guinea's National Maritime Safety Authority rescue coordinator, Captain Nurur Rahman, said the true figure was likely lower.

"I cannot confirm or deny the 350 missing number. It is hearsay," Rahman said. "I have not seen the manifest as yet, but it is likely around 300."

Rahman said there had been no reports of bodies being found.

Ship operator Star Ships could not be immediately contacted for comment.

CHAPEL HILL, N.C. (AP) ? Charlie Spoonhour, the popular, homespun coach who took Saint Louis to three NCAA tournaments behind a prolific offense, has died after battling a lung disease. He was 72.

Spoonhour, who also coached at Missouri State and UNLV, died Wednesday, said Chuck Harker, the funeral director at Walker's Funeral Home in Chapel Hill. Spoonhour was diagnosed in 2010 with idiopathic pulmonary fibrosis, which required a transplant at Duke University Medical Center in nearby Durham, N.C.

In 19 seasons as a Division I head coach, Spoonhour was 373-202.

He built his reputation at Missouri State, then known as Southwest Missouri State, where he was 197-81 with five NCAA tournament appearances from 1983-92. The school planned a moment of silence during a pre-game tribute to Spoonhour before its game against Wichita State on Wednesday night.

"The entire Missouri State University family is deeply saddened by the passing of Coach Spoonhour," athletic director Kyle Moats said. "His legacy is one of class, distinction and achievement, and he will be dearly missed by the many lives he touched in his many endeavors."

Spoonhour was a popular coach and his NCAA appearances with Saint Louis in the 1990s came with teams who swamped opponents with a barrage of 3-pointers. This was just the latest version of "Spoonball," which was a more patient, possession-oriented offense in Spoonhour's days at Southwest Missouri State.

After compiling a 122-90 record in seven seasons at Saint Louis, he retired briefly then returned to coaching at UNLV, going 54-31 in three seasons. He retired following the 2003-04 season.

Saint Louis ended a 20-year NCAA tournament drought under Spoonhour, who produced consecutive 23-win seasons and back-to-back NCAA berths in 1993-94 and 1994-95. Those teams relied heavily on sharpshooters Erwin Claggett, Scott Highmark and H Waldman, and played to sellout crowds of 21,000 while Spoonhour prowled the sidelines clad in black turtleneck sweater to offset his close-cropped white hair.

Saint Louis' first-round victory over Minnesota in 1995 was the school's first in 43 years. The Billikens lost in the second round to a Wake Forest team led by future NBA star Tim Duncan.

Now headed by Rick Majerus, Saint Louis was ranked for one week earlier this season, its first Top 25 appearance since Spoonhour's glory days in1994.

In 2008, TransCanada Corp. applied for a presidential permit from the State Department to construct and operate an oil pipeline across the U.S.-Canada border in a project known as Keystone XL. The Keystone XL pipeline would transport oil produced from oil sands in Alberta, Canada, to Gulf Coast refineries. The permit application was subjected to review by the State Department pursuant to executive branch authority over cross-border pipeline facilities as articulated in Executive Order 13337.

After several phases of review, on November 10, 2011, the State Department announced that it would seek additional information about alternative pipeline routes before it could move forward with a national interest determination. In response, several pieces of legislation were introduced, including Title V of the Temporary Payroll Tax Cut Continuation Act of 2011. Title V dictated that President must grant the Keystone XL pipeline permit within 60 days of the law?s enactment, unless the President determined that the pipeline is not in the national interest. If the President did not make a national interest determination and took no action to grant the permit, then the law provided that the permit ?shall be in effect by operation of law.? The Temporary Payroll Tax Cut Continuation Act of 2011 (P.L. 112-78), including Title V addressing the Keystone XL permit, was enacted on December 23, 2011.

Pursuant to the requirements of Title V, on January 18, 2012, the State Department recommended that ?the presidential permit for the proposed Keystone XL pipeline be denied and, that at this time, the TransCanada Keystone XL Pipeline be determined not to serve the national interest.? The same day, the President stated his determination that the Keystone XL pipeline project ?would not serve the national interest.?

New legislative activity with respect to the permitting of border-crossing facilities, a subject previously handled exclusively by the executive branch, has triggered inquiries as to whether this raises constitutional issues related to the jurisdiction of the two branches over such facilities. Additionally, as states have begun to contemplate taking action with respect to the pipeline siting, some have questioned whether state siting of a pipeline is preempted by federal law. Others argue that states dictating the route of the pipeline violates the dormant Commerce Clause of the Constitution which, among other things, prohibits one state from acting to protect its own interests to the detriment of other states.

This report reviews those legal issues. First, it suggests that legislation related to cross-border facility permitting is unlikely to raise significant constitutional questions, despite the fact that such permits have traditionally been handled by the executive branch alone pursuant to its constitutional ?foreign affairs? authority. Next, it observes generally that state oversight of pipeline siting decisions does not appear to violate existing federal law or the Constitution. Finally, the report suggests that State Department?s implementation of the existing authority to issue presidential permits appears to allow for judicial review of its National Environmental Policy Act determinations.
